General terms and conditions
1. Scope of application
a) The following General Terms and Conditions shall apply to all business relations between "flowStick Visions - Thomas Tockner" and the customer. The version valid at the time of the conclusion of the contract is decisive. Deviating regulations are only valid if they have been individually agreed upon.
b) The main products sold by the online shop www.flowstick.at are the training tool „flowStick“ and accessories for brass instruments.
2. Conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer. By clicking on the button "Buy now", the customer makes a binding offer to conclude a purchase contract. The acceptance of the offer by "flowStick Visions - Thomas Tockner" is affected by the dispatch of the goods, for which you will receive a written confirmation of dispatch by e-mail.
3. Delivery
Partner for shipping: Österreichische Post AG
The items will be shipped immediately unless otherwise stated in the product description.
Dispatch usually takes place within 1 to 3 working days. In the case of payment in advance, dispatch will be initiated after receipt of payment and for all other payment methods after the conclusion of the contract.
4. Shipping costs
Delivery within Austria costs EUR 2,70.
Delivery to all EU countries costs EUR 6.90.
Delivery to all other countries costs EUR 14.90.
The costs for return shipping will not be covered.
For deliveries outside the EU, customs duties may apply, which are not included in the stated price.
5. Prices
All prices quoted are gross prices in euros and include statutory value added tax. Shipping costs and any customs duties may be added.
6. Means of payment
Payment can be made using Shopify Payments and PayPal.
7. Reservation of proprietary rights
We reserve the right of ownership of the delivered goods until full payment has been received.
8. Right of revocation
a) General right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods;

through a clear declaration (e-mail) of your decision to revoke this contract. You can use the model withdrawal form for this purpose, which is, however, not mandatory.
To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs, without delay and at the latest within fourteen days of the day we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods without undue delay and in any event no later than fourteen days from the day you notify us of the cancellation of this contract to us to return or hand over the goods. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that are not necessary for checking the goods' condition, properties, and functionality.
b) Exclusion from the right of withdrawal
The right of withdrawal exists in principle but is not applicable due to § 18 para. 1 no. 5 FAGG in the case of:
Sealed goods that are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed.
Please note that for this reason the return of unsealed flowSticks (including opened, missing plastic cover) is excluded.
According to § 18 FAGG, there is no right of withdrawal for goods that have been manufactured according to customer specifications. This applies to the entire series of Leitner4all trumpet stands.
9. Warranty
If the goods are damaged or have any other defect, you are entitled to statutory warranty rights. The warranty is excluded for defects caused by the customer. Defects must be claimed immediately after receipt of the goods by the customer in text form (e-mail) and picture proof. Please make sure that we require meaningful pictures of the product and, if applicable, of the packaging.
10. Contract language
Privacy policy, general terms and conditions, and the cancellation form are offered in English. All other contractual matters and also complaints can only be made in German.
11. Data protection
Our privacy policy can be found on this website under ‘Privacy Policy’ and will be provided upon request at any time.
12. Applicable law/ place of jurisdiction
Austrian law shall apply exclusively. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.
